Your privacy is very important to Schladitz Consulting, a Swiss company with its registered domicile in Kerzers, Switzerland.

This privacy policy (the “Policy”) describes the practices that apply to our Websites. We have prepared the Policy in order to provide you with as much information as possible about our practices, so that you can make an informed decision about the extent of your use of our site. When we refer in this Privacy Policy to the “processing” of personal data, we mean any handling of personal data – for example, collecting, management, storing, using, transferring disclosing, deleting, accessing, etc. 

This Privacy Policy applies to the sites and all products and services offered by Schladitz Consulting.

Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including but not limited to, when you visit our site, subscribe to the newsletter, download ebooks, complete the questionnaire, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. You may be asked for, as appropriate, name, email address, phone number. You may, however, visit our Site anonymously. We will collect personal identification information from users only if they voluntarily submit such information to us. You can always refuse to supply personal identification information, except that it may prevent you from engaging in certain Site related activities.

 

How We Process Data 

  • Using our Websites without registering

When you visit our Websites, we process usage data about your use of our Websites (the “Session Data”) such as how our Websites are navigated, how many visitors arrive at specific pages, the length and frequency of stays at our Websites, the language preferences selected by our visitors, the types of browsers and computer operating systems used by our visitors and Internet Protocol (“IP“) addresses from which our visitors connect to our site (meaning the address that identifies the device you use to connect to our site). We process Session Data to analyse the Internet traffic on our Websites and to improve the way our Websites function. 

  • Using our Websites with registration

Our Websites offer various services such as ebooks (free and fee-paying), online appointments, online questionnaires, etc. (the “Services”). To use the Services, you will have to register on one of the Websites. We will only process the information about you that you voluntarily share with us. Information you may share with us includes your name, e-mail address, mailing address, home or work telephone number (the “Personal Data”).

If you decide to register with us, we may process the Personal Data for the purpose of managing and providing the Services offered on our Website, preventing the misuse of our Services and for market research and marketing by telephone, text messaging (sms), picture messaging (mms) and e-mails on products, and services of Schladitz Consulting and to build individual and group profiles (profiling). 

How We Share Data

We may share any Session Data and Personal Data with third party service providers (the “Service Providers”) for obtaining professional, technical or organizational services that are functional to the managing of our Websites. The Service Providers will process the Session Data and Personal Data as data processors on behalf of us. We will share with the Service Providers only that Session Data and Personal Data that are necessary to the performance of their respective functions. The Service Providers will have to contractually agree to only process the Session Data and Personal Data shared with them for the processing purposes specified above. If any recipients of the Session Data and Personal Data are located in countries where data protection laws do not provide an equivalent level of protection to the laws in Switzerland or the European Economic Area, we will contractually ensure that Session Data and Personal Data is processed with an equivalent level of protection as to the laws in Switzerland or the European Economic Area.

Your Session Data and Personal Data may also be shared by us if we consider it necessary or appropriate to do so in order to comply with any applicable laws and regulations, in case of judicial proceedings, request by competent courts and authorities or other legal obligation, to protect or to defend our rights and property. 

How We Use Google Analytics

The Websites use “Google Analytics”, a software programme provided by Google Inc. (“Google”). Google Analytics uses cookies and text files that are stored on your computer or mobile device to help analyse your use of the Websites. The information generated by the cookie about your use of the Websites (including your IP address) is sent to a Google server in the U.S. and stored there. Google will use this information to evaluate your use of the Websites, compiling reports on website activity for website operators and providing other website activity and internet related services. In addition, Google may also transfer this information to third parties if required by law or if third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by changing the settings on your browser. However, in this case, you may not be able to use all features of the Websites. By using the Websites, you consent to the processing of data about you by Google in the manner described and for the aforementioned purpose.

How We Use Social Plugins and Links

Our Websites use social plugins (the “Plugins”) provided by social networks (e.g. facebook.com and youtube.com). The Plugins are identifiable by the logo or the respective social network. The Plugins enable you to set bookmarks on these pages and share the bookmarks with other users of social networks.

When you visit a page of our Websites that contain Plugins, your browser establishes a direct connection to the social network servers. The embedded Plugins provide the social network with the information that you have accessed the corresponding page of our Websites. If you are logged into the social network, your visit can be assigned to your social network account. If you interact with the Plugins, for example by clicking the Facebook “Like-Button”, or entering a comment, the corresponding information is transmitted from your browser directly to the social network and stored by it. Even if you are not logged into the social network, there is a possibility that the Plugins will transmit your IP-address to the social network.

For information on the purpose and scope of data processing by the social network, as well as your rights in this respect, and setting options for protecting your privacy, please visit the social network website’s privacy policy. We have no influence on the data gathered by the Plugins.
Our Websites further provide links to other sites. When you click on one of these links, you are leaving our Websites and visiting another internet site that we do not control and for which we cannot be responsible.
You should carefully review the privacy statements or policies on any other internet site that you visit or social network because those privacy statements or policies will apply and may be very different from our Policy. 

How We Use Collected Information

Schladitz Consulting may collect and use users’ personal information for the following purposes:

  • To personalize user experience: We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site;
  • To improve our Site: We may use feedback you provide to improve our products and services;
  • To process payments: We may use the information you provide about yourself when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service;
  • To forward ebooks, run a promotion, contest, survey or other Site feature: To send you information you agreed to receive about topics we think will be of interest to you;
  • To send periodic emails: We may use the email address to send you information and updates pertaining to your order. It may also be used to respond to your inquiries, questions, and/or other requests. If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed instructions at the bottom of each email or you may contact us via our Site.

 

How We Protect Data

We maintain technical and organizational security procedures to maintain the security of your Session Data and Personal Data and to safeguard your Session Data and Personal Data against unauthorized or unlawful processing and/or against accidental loss, alteration, disclosure or access. However, please be aware that there are inherent risks in transmitting information by use of the Internet and other online or electronic transmission systems and that we cannot guarantee the security of information transmitted in this way. 

Your rights

In accordance with the Federal Law on data protection dated 19 June 1992 and its implementing decree, and also with European Regulation No. 2016/679/UE dated 27 April 2016 (applicable with effect from 25 May 2018), you have the following rights:

  • To exercise your right of access, in order to obtain information on personal data concerning you;
  • To request the updating of your data, if these are not accurate;
  • To request the portability or deletion of your data;
  • To request deletion of your account;
  • To request limitation of the extent of processing of your data;
  • To oppose the processing of your data, for legitimate reasons;
  • To oppose, or withdraw your consent to the use, by our departments, of your contact details for sending you our documents, invitations, and newsletter via email or post.

For reasons of security and in order to avoid any fraudulent requests, this request must be accompanied by a proof of identity. The proof of ID will be destroyed once the application has been processed.

 

How Long We Retain Data

We will retain your Session Data and Personal Data for as long we consider it necessary or appropriate to do so in order to comply with applicable laws, or for as long as we consider it necessary for the purposes for which it is processed. We will delete your Session Data and Personal Data when it is no longer needed and, in any case, upon expiration of the maximum storage term set forth by applicable law. 

How We Notify Changes to Our Privacy Policy

We may change this Policy from time to time. If we decide to change this Policy in a material way, we will revise the updated date at the bottom of this page. You are encouraged to frequently check the page for any changes to stay informed about how we are helping to protect the personal information we collect. Limitation of Liability and Final Provisions

  1. a) Applications or technologies managed by third parties

You acknowledge that browsing the internet entails certain risks that we cannot control. We do not, in particular, control third party applications or other tracking technologies, even though they are present on our website. The confidentiality policies of these third parties should be consulted. We decline all responsibility in the case of an attack, infringement, or damage caused by third parties’ applications or third parties’ tracking technologies.

 

  1. b) In the case of cyber attack

In the case of cyber attack, we do not assume any responsibility in the event of any infringement or damage caused by this intrusion, unless this is due to gross negligence.

 

  1. c) Links to other websites

The website may contain hypertext links to other sites that do not belong to Schladitz Consulting. In consequence, we cannot be held responsible for the content or functioning of these sites, or for any damage arising from the use of these sites. The user therefore connects to these third party websites at his/her own risk.

 

  1. d) Applicable law and forum

In the case of a dispute, only the courts of Bern (Switzerland) shall be competent and Swiss law is applicable.
